These Terms of Service ("Terms") govern your use of lightenmd.com and the LightenMD program (the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What LightenMD Is (and Is Not)
LightenMD provides a weight-management program: access to telehealth consultations with independent, US-licensed medical providers, personalized program support, and care coordination. LightenMD is not a medical provider, pharmacy, or medication seller. All medical decisions — including whether any medication is appropriate for you — are made solely by independent licensed providers. Medications, when prescribed, are dispensed and billed separately by licensed pharmacies.
2. Eligibility
You must be at least 18 years old, reside in a state where the program is available, and provide accurate, complete information. Completing our quiz or intake does not guarantee treatment; providers may determine the program is not appropriate for you.
3. Not for Emergencies
The Services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
4. Telehealth
Clinical services are delivered via telehealth by independent providers. Your use of telehealth services is subject to our Telehealth Informed Consent. Telehealth has benefits and limitations, including that a provider may determine telehealth is not appropriate for your situation and refer you to in-person care.
5. Fees and Billing
- Program fees are billed by LightenMD on a monthly, recurring basis at the rate shown at signup, until you cancel.
- Medication costs are not included in program fees and are billed separately by the dispensing pharmacy.
- There are no membership or hidden fees beyond the stated program price.
- You authorize us and our payment processor to charge your payment method on file for recurring program fees.
6. Cancellation and Refunds
You may cancel at any time, effective at the end of the current billing period. If a provider determines that treatment is not appropriate for you, you will receive a full refund of the associated program fee. See our Refund Policy for details.
7. Your Responsibilities
- Provide truthful, accurate, and complete health information
- Follow provider instructions and report side effects or concerns promptly
- Keep your account credentials secure and your contact information current
- Use the Services only for yourself, not on behalf of others
8. Intellectual Property
All content on the Services (text, design, logos, software) is owned by or licensed to LightenMD and protected by law. You may not copy, modify, or distribute it without permission.
9. Prohibited Uses
You may not misuse the Services, including by submitting false information, attempting to obtain medication for another person, interfering with the operation of the site, or violating applicable law.
10. Disclaimers
The Services are provided "as is" without warranties of any kind, to the maximum extent permitted by law. LightenMD does not practice medicine and makes no guarantee of specific health outcomes or weight-loss results. Information on the site is for general education and is not medical advice. 11. Limitation of Liability
To the maximum extent permitted by law, LightenMD's total liability arising out of or relating to the Services will not exceed the program fees you paid to LightenMD in the twelve (12) months preceding the claim. LightenMD is not liable for indirect, incidental, consequential, or punitive damages. Independent providers and pharmacies are solely responsible for the clinical and pharmacy services they render.
12. Dispute Resolution
Any dispute arising from these Terms or the Services will first be attempted to be resolved informally by contacting support@lightenmd.com. Unresolved disputes will be resolved by binding individual arbitration, and you waive participation in class actions, to the extent permitted by law.
13. Changes
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance. Material changes will be notified via the site or email.
