Terms of Service

These Terms of Service ("Terms") govern your use of lightenmd.com and related services ("LightenMD," "we," "us"). LightenMD is a trade name of DC Northern Holdings LLC, an Alaska limited liability company. By creating an account or using our services, you agree to these Terms.
1. What LightenMD does
LightenMD provides a technology platform, membership and care-coordination services. We do not practice medicine and we are not a pharmacy. Medical services are provided by independent, licensed clinicians affiliated with an independent, physician-owned medical group (the "Medical Group"), who exercise their own independent clinical judgment. Medications are dispensed by licensed pharmacies.
2. No guarantee of a prescription
Completing a questionnaire or paying for a membership does not guarantee a prescription. A clinician will prescribe medication only if it is medically appropriate for you. Clinicians may request more information, a video visit, labs or other records before making a decision.
3. Eligibility
You must be at least 18 years old, located in a state where our services are available when you use them, and able to form a binding contract. You agree to provide complete, accurate and truthful information about your health and identity, and to keep it up to date. Providing false information may be dangerous to your health and is grounds for termination.
4. Not for emergencies
LightenMD is not for medical emergencies. If you think you're having a medical emergency, call 911 or go to the nearest emergency room.
5. Memberships, billing and cancellation
Pricing, billing, renewal, cancellation and refunds are governed by our Billing, Cancellation & Refund Policy, which is part of these Terms. Memberships renew automatically each month (or at the end of a prepaid term) until you cancel.
6. Medication purchased from third parties
For some brand-name medications, you pay the manufacturer's self-pay pharmacy directly. Those purchases are between you and that pharmacy and are subject to its terms and prices, which LightenMD does not control.
7. Your account
You're responsible for keeping your login credentials secure and for activity on your account. Tell us right away at support@lightenmd.com if you suspect unauthorized use.
8. Acceptable use
You agree not to misuse our services, including by impersonating another person, obtaining medication for someone else, reselling medication, interfering with the platform, or using it for any unlawful purpose.
9. Intellectual property
The LightenMD name, logo, website content and software belong to DC Northern Holdings LLC or its licensors. Third-party trademarks belong to their owners.
10. Disclaimers
Our services and website content are provided "as is." Website content is for general information and is not medical advice. Individual results vary, and we do not guarantee any particular outcome, including weight loss.
11. Limitation of liability
To the fullest extent permitted by law, LightenMD will not be liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to our non-clinical services will not exceed the amounts you paid to LightenMD in the 3 months before the claim. Nothing in these Terms limits liability that cannot be limited under law. Clinical care is the responsibility of the treating clinician and Medical Group.
12. Termination
You may close your account at any time. We may suspend or terminate access if you violate these Terms or if continuing would be unsafe or unlawful.
13. Governing law
These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Anchorage, Alaska, except where applicable law requires otherwise.
14. Changes
We may update these Terms. If changes are material, we'll notify you by email or on the site before they take effect. Continuing to use LightenMD after that means you accept the updated Terms.
